Luna Motivation Terms and Conditions
Last updated: 02/09/2025
1. About us
These terms apply to purchases made through from Ray Zhang, trading as Luna Motivation.
Email: luna.motivation08@gmail.com
In these terms, “we”, “us” and “our” mean [full legal name] trading as Luna Motivation. “You” and “your” mean the customer.
These terms apply to consumers purchasing products mainly for personal use. If you are buying wholly or mainly for business purposes, contact us before ordering so that we can confirm whether these consumer terms apply.
2. Products and product information
We take reasonable care to ensure that product descriptions, photographs, colours, materials, dimensions, care instructions and sizing information are accurate and up to date.
The product page and your order summary contain the main characteristics of the product you are buying. If a product includes accessories, packaging or other items shown in a photograph, this will be stated on the product page.
Product images are intended to give a fair representation of the products. Colours may appear slightly different depending on your device, screen settings, lighting and photography conditions.
Where reasonably applicable, products may have minor variations in colour, texture, print placement, stitching, finish or measurements because of fabric batches, printing processes or manufacturing tolerances. These variations will not be treated as a material change where the product remains as described.
Any stated measurements are approximate. Please check the relevant size guide before ordering. A reasonable manufacturing tolerance does not remove your statutory rights if the product is materially different from its description or unsuitable for its ordinary purpose.
If a material variation, description error or availability problem is identified before acceptance of your order, we may contact you to offer an alternative or cancel and refund the affected order.
3. Prices, VAT and pricing errors
All prices are shown in pounds sterling (GBP).
Unless stated otherwise, product prices shown to consumers include any VAT that we are legally required to charge. If Luna Motivation is not VAT registered, no VAT is charged or separately itemised.
Delivery charges and any other mandatory charges will be shown before you place your order. If we accept orders outside the UK, any import VAT, customs duty or other charges not included at checkout will be disclosed where applicable and may be payable by you.
We may change prices before we accept an order. A price change will not affect an order already accepted.
We try to ensure that prices, product details and promotional discounts are accurate. If there is an obvious pricing, stock, product or promotional error, we may reject the order before acceptance, particularly where the error should reasonably have been apparent. If payment has already been taken, we will refund it using the original payment method.
We will not use this clause to remove statutory rights or automatically undo a contract that has already been accepted except where permitted by law.
4. How the contract is formed
The ordering process is:
Cart
Adding a product to your cart does not reserve it and does not create a contract. Stock and prices may change until your order is accepted.
Checkout
At checkout, you must review the product, quantity, size, colour, delivery address, delivery method and total price. You should correct any errors before proceeding.
Payment
When you click the final button labelled “Pay now”, “Place order” or similar, you submit an offer to buy the products shown in your order. You must pay when placing the order.
Payment authorisation or payment being taken does not, by itself, mean that we have accepted your order.
Order confirmation
We will normally send an automated email confirming that we have received your order. This email confirms receipt of your order and may confirm payment status, but it is not acceptance unless it clearly states that your order has been accepted.
Acceptance
A binding contract is formed when we send you a dispatch or acceptance email confirming that we have accepted the relevant order, or when we dispatch the goods if that happens first.
If we cannot accept your order, we will notify you and refund any payment taken. Reasons may include lack of stock, a delivery restriction, an obvious error, a payment or security concern, or a failure to comply with a promotional condition.
If we accept only part of your order, we will identify the accepted and rejected items and refund any rejected items.
We will provide confirmation of the contract and these terms in a form that you can save, no later than delivery.
5. Payment
We accept the payment methods displayed and available at checkout at the time you order. These may include debit or credit card payments and PayPal where those options are shown.
No other payment method is accepted unless we agree to it in writing.
Payments may be processed by third-party payment providers. Those providers may carry out their own security and fraud checks and may apply their own terms.
You confirm that:
- the payment information you provide is accurate;
- you are authorised to use the payment method; and
- the payment is not being made fraudulently or without the account holder’s permission.
We may place an order on hold or request reasonable verification information where necessary to check payment or delivery details. We will handle personal information in accordance with our Privacy Policy(/privacy-policy/
We will not ask you to send us your full card number, security code or account password by email.
We do not add a fee merely because you use a consumer debit card, credit card or PayPal.
If a payment is reversed after delivery and the reversal does not relate to a valid refund, statutory cancellation, faulty-goods claim or other lawful dispute, the price remains payable. We may contact you to resolve the issue or pursue recovery through lawful means. Nothing in this clause prevents you using a valid payment-provider dispute process or statutory right.
6. Delivery
See our [Shipping Policy](/shipping-policy/) for delivery destinations, delivery charges, available services, dispatch times and estimated delivery periods.
We deliver only to destinations shown as available at checkout. Delivery dates are estimates unless we expressly state that a date is guaranteed.
Unless a different period has been agreed, we will deliver without undue delay and normally within 30 days of contract formation.
We may send an order in more than one parcel. We will not charge additional delivery fees merely because an order is split.
The goods remain at our risk until they come into your physical possession or the physical possession of a person you have identified to receive them. If you expressly authorise delivery to a safe place or named person, delivery there or to that person will normally count as delivery to you.
If you independently appoint a carrier that we did not offer as a delivery option, risk may pass to you when the goods are handed to that carrier.
You are responsible for providing an accurate and complete delivery address and for following reasonable collection instructions. If delivery fails because the address was incorrect, incomplete or you did not collect the parcel after a delivery attempt, we may require payment of the reasonable direct cost of re-delivery if you ask us to send the order again. This will not apply where the delivery failure was caused by us or where mandatory consumer rights provide otherwise.
Tracking records, delivery photographs, parcel weights and courier scans may be considered when investigating a delivery dispute. They are evidence only and do not remove our legal responsibility where goods have not been delivered to you or your authorised recipient.
Please contact us promptly if a parcel appears damaged, incomplete or missing. Photographs and packaging information may help us investigate, but failure to report a problem immediately does not remove your statutory rights.
7. Statutory cancellation rights
If you buy goods online, you normally have the right to cancel without giving a reason.
You may cancel within 14 days after the day on which you, or a person you nominate who is not the carrier, receives the goods. If goods in one order are delivered separately, the period normally runs from the day after the last item is received.
To cancel, email us at luna.motivation08@gmail.com with a clear statement that you want to cancel. You may use the model cancellation form at the end of these terms, but you do not have to use it.
After telling us that you wish to cancel, you must return the goods within 14 days.
Unless the goods are faulty, misdescribed or otherwise subject to a statutory remedy, you normally pay the direct cost of returning goods cancelled under the statutory cooling-off right. We will refund the cost of standard delivery. We do not have to refund any additional amount paid for an upgraded delivery option.
We will refund you within 14 days of receiving the returned goods or receiving evidence that you sent them back, whichever happens first. We may withhold the refund until that point.
Refunds will normally be made using the original payment method unless we agree otherwise.
You may handle goods as reasonably necessary to inspect their nature, characteristics and functioning, as you could in a shop. You may try clothing on, but you should not wear it beyond what is reasonably necessary for inspection.
We may make a proportionate deduction for any diminished value caused by handling beyond what is reasonably necessary to inspect the goods. We will not make a deduction merely because packaging or tags have been opened where doing so was reasonably necessary to inspect the goods.
The statutory cancellation right may not apply to products that are clearly personalised or made to your specifications, or to sealed products that cannot be returned for health or hygiene reasons once unsealed, where the law provides an exception. Standard products being produced or dispatched after an order is placed are not automatically exempt merely because they are made to order.
You may ask us to cancel before dispatch, but we cannot guarantee that we will be able to stop an order after it has been accepted or entered fulfilment. This does not affect your statutory cancellation rights.
8. Returns Policy
Our [Returns Policy](/returns-policy/) explains the return address, packaging requirements and practical return process.
The Returns Policy does not remove or restrict statutory cancellation rights, rights relating to faulty or misdescribed goods, or any other consumer rights. If there is a conflict, the law applies.
9. Faulty, damaged or misdescribed goods
Your statutory rights are not affected by these terms.
Goods must be of satisfactory quality, fit for their ordinary purpose and as described. Depending on the circumstances, you may have the right to:
- reject faulty goods and receive a refund;
- request a repair or replacement;
- receive a price reduction; or
- finally reject the goods and receive a refund.
The short-term right to reject faulty goods normally applies within 30 days of delivery, subject to the applicable legal rules. After that period, repair or replacement may be available before a price reduction or final rejection becomes available.
Please contact us with your order number, a description of the problem and, where reasonably possible, photographs. We may ask to inspect the goods or request reasonable evidence to help establish what happened. We will not make an unreasonable evidence requirement a condition of exercising a statutory right.
Where required by law, we will reimburse reasonable costs of returning faulty or misdescribed goods.
Statutory remedies do not generally cover damage caused by accidental damage, misuse, unauthorised alterations, normal wear and tear, or failure to follow reasonable care instructions where that caused the problem. We will assess each claim on its facts.
10. Promotions and discount codes
Each promotion or discount code may have additional conditions displayed with the promotion. These conditions may include:
- minimum spend requirements;
- excluded products, sale products, delivery charges or gift cards;
- expiry dates;
- one use per customer, order or household;
- restrictions on combining codes; and
- limits on the number of discounted products.
Unless stated otherwise, discount codes are non-transferable, have no cash value and cannot be applied retrospectively to an order already placed.
You must not obtain, copy, alter, resell or distribute a discount code contrary to its stated conditions. You must not use automated purchasing, multiple accounts or other methods to circumvent a stated limit.
We may refuse a code or reject an order before acceptance where the code has been used contrary to its conditions, obtained through deception, duplicated due to a technical error or used in connection with suspected fraud. If payment has been taken, we will refund the rejected order.
For voluntary returns of part of an order, we may recalculate a conditional discount so that the remaining items meet the promotion’s stated conditions. We will explain any such calculation. This does not limit statutory cancellation rights or remedies for faulty goods.
Promotions and discount codes do not remove statutory rights.
11. Website use, accounts and fraud prevention
You must provide accurate and current information when ordering and must keep account credentials confidential.
You must not use the website or checkout:
- for unlawful purposes;
- to interfere with or damage the website;
- to use bots or automated checkout tools;
- to obtain products or discounts by deception;
- to submit deliberately false delivery, payment or return information; or
- to make a payment or claim that is knowingly unauthorised or dishonest.
Where we have reasonable grounds to suspect payment fraud, deliberate deception, automated purchasing, coupon abuse, a materially inaccurate address or other unlawful activity, we may:
- delay processing;
- request reasonable verification;
- limit quantities;
- refuse an order before acceptance; or
- suspend access to an account.
We will act proportionately and will not use this section to reject a genuine statutory cancellation, faulty-goods claim or other lawful consumer right.
If we do not accept an order, we will refund any payment taken. After acceptance, we may end a contract only where permitted by law, including where there has been a material breach of these terms. We will refund any unfulfilled goods affected by such termination.
We may retain relevant records and share information with payment providers, fraud-prevention services, couriers, insurers, professional advisers or law-enforcement authorities where legally permitted.
12. Intellectual property
The Luna Motivation name, branding, artwork, clothing designs, logos, photographs, illustrations, written content, website layout and other materials are owned by us or licensed to us.
Buying a physical product does not transfer ownership of the underlying artwork, design, branding or other intellectual property.
You may use the website for personal, non-commercial purposes and may lawfully wear or resell a physical product that you own. You must not copy, reproduce, modify, print, manufacture, distribute, sell or commercially exploit Luna artwork, designs, photographs, text or branding without our written permission.
13. Liability
Nothing in these terms excludes or limits liability that cannot legally be excluded or limited, including liability for:
- death or personal injury caused by negligence;
- fraud or fraudulent misrepresentation;
- defective products where liability cannot legally be excluded;
- supplying goods that we do not have the right to sell;
- goods that are not as described, satisfactory quality or fit for purpose; or
- any statutory consumer right or remedy.
Subject to the above, we are responsible for foreseeable loss or damage directly caused by our breach of these terms or our negligence.
We are not responsible for loss that was not foreseeable, loss caused by your breach of these terms, or damage caused by misuse of a product or failure to follow reasonable care instructions.
We do not guarantee that the website will always be available or free from technical errors. This does not affect an accepted order or your statutory rights.
14. Events outside our reasonable control
We are not responsible for delay caused by events outside our reasonable control, such as severe weather, fire, flood, industrial action, transport disruption, supplier failure, power failure, cyberattack or changes in law.
We will take reasonable steps to notify you and reduce the effect of the delay. This clause does not remove any right you have to cancel, obtain a refund or use another legal remedy.
15. Governing law and courts
This clause assumes that Luna Motivation is established in England or Wales.
These terms and any contract between you and us are governed by the law of England and Wales. The courts of England and Wales have non-exclusive jurisdiction.
If you live in Scotland or Northern Ireland, you may also bring proceedings in the courts of the part of the UK in which you live. Nothing in these terms removes any mandatory consumer protection that applies to you.
If the business is actually established in Scotland or Northern Ireland, this clause should be amended before publication.
16. Changes and general terms
We may update these terms for future orders by publishing a new version on the website. The version in force when your order is accepted applies to that contract.
If any part of these terms is found to be invalid or unenforceable, the remaining provisions will continue to apply.
If we do not enforce a provision immediately, that does not mean that we waive our right to enforce it later.
17. Contact and complaints
For questions, complaints, cancellation requests or order issues, contact:
Email: luna.motivation08@gmail.com
Please include your order number. Do not send full payment-card details by email.
